By proceeding with a clear affirmative action (e.g., clicking “I Agree” during account creation), you, the Data Principal, provide Free, Specific, Informed, Unconditional, and Unambiguous consent for us to process your data as outlined below.
1. Personal Data We Collect: To deliver fresh vegetables, fruits, and groceries to your doorstep, we collect:
- Identity & Contact Data: Full name, mobile number, and email address (info@ekrushak.com).
- Location Data: Exact delivery address, and landmark to facilitate timely dispatch and navigation.
- Transaction Data: Order history, EKrushak Wallet balance, and payment method details. (Note: Financial credentials like UPI PINs are processed securely by PCI-DSS compliant gateways and are never stored by EKrushak).
- Device & Usage Data: IP address, browser type, and interaction metrics, subject to explicit Cookie Consent.
2. Purpose of Processing: We adhere to the principle of purpose limitation. Your data is processed exclusively to:
- Fulfill, manage, and deliver your fresh produce orders.
- Manage your EKrushak account and Wallet balance.
- Coordinate deliveries via SMS, phone calls, and WhatsApp.
- Process grievances, returns, and refunds.
- Comply with applicable Indian taxation and corporate laws.
3. WhatsApp & Electronic Communication Consent: By registering on EKrushak and checking the communication consent box, you explicitly agree to receive operational and promotional communications via WhatsApp, SMS, and email.
- Operational (Mandatory for Delivery): Order confirmations, out-for-delivery tracking, location requests, and Wallet refund alerts.
- Promotional (Optional): Seasonal harvest alerts and exclusive discounts. You may withdraw consent for promotional messages at any time by updating your account settings or replying “STOP” on WhatsApp.
4. Your Rights as a Data Principal (DPDP Act, 2023): You possess the following rights regarding your personal data:
- Right to Access: You may request a summary of the personal data we process and the third parties (e.g., delivery partners) it has been shared with.
- Right to Correction & Erasure: You may request updates to inaccurate data or the deletion of your data once it is no longer required for its original purpose.
- Right to Withdraw Consent: You can withdraw your consent at any time, though this may restrict our ability to fulfill future orders.
- Right to Nominate: You may nominate another individual to exercise your rights in the event of incapacity.
5. Data Retention & Security: Your data is securely stored on servers located within India. We retain personal data only for as long as you maintain an active account or as required by Indian legal and audit obligations. Upon account deletion, all non-essential data is securely erased.
